Terms and Conditions
General Terms and Conditions:
All prices are listed in Euro without sales tax. INFORCE® and our Webhotel.net division reserves the right to alter prices or content without prior warning.
It is a requirement that the customer is old enough to legally commit to a contract in order to set up a webhotel or to receive any other service from INFORCE® and our Webhotel.net division.
INFORCE® and our Webhotel.net division can at any time alter the term and conditions provided that INFORCE® and our Webhotel.net division subsequently informs the customers about the change.
VAT / Sales Tax:
INFORCE® and our Webhotel.net division is currently based in Denmark, and all danish customers are therefore oblidged to pay VAT and must thus use the danish webshop. Please click on the danish flag or [here] to continue.
Customers from other parts of Scandinavia, Europe, North America and other parts of the world will have to contact their local VAT / Sales Tax department or government office to declare locally.
INFORCE® and our Webhotel.net division and INFORCE A/S are under no circumstances responsible for non-payment of VAT / Sales Tax from customers outside Denmark, who does not declare such payment locally in their own country.
Usage:
All materials placed by the customer on INFORCE® and our Webhotel.net division's servers must comply with international copyright legislation and may not violate a third partys rights. The website may not contain racist or illegal materials, and in particular we do not host sites relating to gambling, sex & pornography and those of radical/extremist political or religious organizations.
We reserve the right to form our own opinion of content and reject what we find undesirable or questionable.
INFORCE® and our Webhotel.net division is not to be used for storage of huge files like zip archives, mp3s and similar; it is a display of a business' digital face. Thus it is not allowed to have large files available for unlimited download.
So-called 'spamvertising' (advertising though the use of spam/ube/uce) for a site hosted at webhotel.net is strictly forbidden regardless of the mailserver used. Spamming is a runaway menace that we do not condone in any way, both directly and indirectly.
Violation of these rules will result in immidate closure of the website without prior warning from INFORCE® and our Webhotel.net division.
Change of commitment:
The customer can at any time change commitment to something with a higher cost. The prepaid commitment will then be deducted from the new fee. Changing to a commitment with a lower fee can only happen at the end of the term.
Liability:
INFORCE® and our Webhotel.net division disclaims all responsibility for loss of data, lost profits and other direct or indirect loss. This applies regardless of the circumstances, including (but not limited to) system crash, unauthorized access or any lack of service or delivery of services ordered. The customer is wholly responsible for backing up the materials hosted on the website.
Payment:
Invoices are issued in advance for 12 months. The commitment with be automatically renewed and the end of term unless a written cacellation is received no later than 30 days before the end of term. If the payment is late INFORCE® and our Webhotel.net division will add interest of 1% of the total amount owed calculated from the invoice date. Also a late fee of 25 Euro will be added and all webhotel or other servies will be closed down pending payment.
INFORCE® and our Webhotel.net division has the right to require payment in full before any service is restored. Services ordered by mistake will not be refunded.
Termination/Cancellation:
INFORCE® and our Webhotel.net division's services are based on a subscription paid in advanced which cannot be cancelled until the end of term unless a refund of the remaining term is voided.
If the customer violates INFORCE® and our Webhotel.net division's terms and conditions INFORCE® and our Webhotel.net division can terminate the customer immidately followed by a written termination. In this case there will be no refunds.
Applications, scripts and other programs:
Websites that has access to PHP/CGI/ASP will be inspected by our staff in order to determine whether they have harmful effects on the server. If that is the case these applications/scripts/programs will be removed or altered in cooperation with the customer.
Mail:
It is not allowed to send out spam or other form of bulk email from INFORCE® and our Webhotel.net division's mail servers.
The use of INFORCE® and our Webhotel.net division's webmail client is at the customers own risk. Any loss, faulty behaviour or other problems cannot be blamed on INFORCE® and our Webhotel.net division nor are INFORCE® and our Webhotel.net division liable for any losses.
All domain are issued a *@[domain] email address unless the customer creates one for themselves. This account will delete all received mail.
Normally mail sent to a non-existant recipient are bounced in a bounce mail. It only makes sense to bounce mail if the sender of the original mail is a human, which almost never is the case in these spam-filled times. The thing is that spammers are running low on usable email addresses and therefore they resort to using a 'dictionary attack' to carpet-bomb each domain by sending their junk to [word/name]@[domain] running through a 'dictionary' (long list of names and initial combinations) to construct email addresses by combining the word with the domain.
As the spammers never use a valid sender this generates many thousands bounces that are all undeliverable, which means they sit in our mailqueue where the server uses time and space on futile delivery attempts each hour which is a massive waste. Regular mails must wait their turn which easily can delay them for hours, especially when there's a surge of spam.
The only way to deal with this is accept all mail and simply delete the unwanted, which is what we do this way.
Domains:
INFORCE® and our Webhotel.net division is not and cannot be liable in case a desired domain cannot be registered.
Domains are typically registered using the 'first come, first serve' priciple and INFORCE® and our Webhotel.net division cannot be held responsible for any delays in effecting the order which may result in someone else acquiring the domain.
INFORCE® and our Webhotel.net division is not liable or responsible for any registration or use of a domain for illigal purposes.
Support:
INFORCE® and our Webhotel.net division does not provide support for in programming and installation of scripts/application/programs.
INFORCE® and our Webhotel.net division can at any time require a fee for support which will be worked out with the customer.
Special cases:
If there are special terms in the contract between INFORCE® and our Webhotel.net division and the customer which conflicts with these terms, the special terms will take precedence over the these general terms.
